Terms of Service

These Terms are a binding agreement between you (“Client,” “you”) and Parvathy Technologies Pvt. Ltd. (“Parvathy AI,” “we,” “us”). If you accept on behalf of an organization, you confirm you have authority to bind it. A signed proposal, statement of work or order form for your project forms part of this agreement and prevails if it conflicts with these Terms.

Parvathy AI is an AI consulting company. We provide Parvathy SUBLIME Web & App Development (Websites, Ecommerce stores, Apps); Parvathy SUBLIME Social Media Marketing (Google Ads, Social Media Management, Meta Ads); and AI Consulting. Parvathy ATLAS and our other products in development are not yet offered, and these Terms do not cover them.

The exact scope, deliverables, timeline and revision rounds of each project are set out in the plan you choose on our website (parvathy.ai/sublime and parvathy.ai/#pricing) or in your written proposal.

Prices are listed in US dollars and exclude local taxes. Website plans: Starter $1,999 and Professional $4,500, one-time and fixed-scope. Enterprise is scoped with you.

• Starter and Professional websites: 50% when you sign the scope, and the remaining 50% at the next milestone set out in your scope.
• Enterprise projects: invoiced per milestone, as set out in the proposal.
• Social media marketing: billed monthly in advance, at the price in your proposal.
• Ecommerce stores, apps and AI consulting: priced in a written proposal and invoiced as that proposal states.
• There is no setup fee beyond the prices above. Work outside the written scope is quoted, and only starts once you approve it.
• Third-party costs you ask us to buy for you (such as licensed media, paid plugins, domains or advertising spend) are billed at cost.

Late payment may lead us to pause work after giving you written notice.

If you are not happy with a website we deliver, tell us in writing within the launch support window of your plan (15 business days for Starter, 30 for Professional, or as set out in an Enterprise proposal). We will first fix the problem; if that does not resolve it, we will rebuild the affected work; and if you are still not satisfied, we will refund the fees you paid for that project, excluding production costs.

Production costs are amounts we paid to third parties for your project, such as licensed media, paid plugins, domains and hosting. Social media marketing can be canceled for the next billing month; fees for months already delivered are not refunded.

• Give us accurate information and the content, approvals and access each project needs, on time.
• Make sure you have the rights to the content, logos and materials you give us.
• Keep your account passwords and access credentials secure.
• Comply with the laws that apply to your business, your marketing and your customer communications.

Delivery dates move by the time we spend waiting for your content, approvals or access.

You may not use our website or services to:

• break the law, infringe anyone’s rights, or harass, defraud or harm others;
• publish spam, malware or deceptive content, including undisclosed AI-generated likenesses of real people;
• attempt unauthorized access to our systems or anyone else’s.

We may suspend services for a serious breach of this section.

Once you have paid in full, you own the website, code and content we create for you. Third-party components (such as open-source libraries, fonts and licensed media) stay under their own licenses, which we pass on to you.

We keep ownership of our pre-existing tools, templates and know-how, and grant you a permanent license to use any of them that are built into your deliverables. Your data, trademarks and materials remain yours; you let us use them only to deliver your project.

Each party will protect the other’s confidential information with reasonable care, use it only for the engagement, and share it only with people who need it and are bound by confidentiality. This does not apply to information that is public, independently developed, or that the law requires us to disclose.

We will deliver the services with reasonable skill and care, as described in your plan or proposal. Apart from that and the happiness guarantee in section 4, the services are provided “as is.” We do not guarantee specific business results, such as search rankings, traffic, followers, leads or sales, because they depend on factors outside our control.

To the extent the law allows, Parvathy AI is not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, data or goodwill. Our total liability under these Terms is limited to the fees you paid us in the 12 months before the claim. Some jurisdictions do not allow these limits; there, they apply as far as the law permits.

You will defend and compensate Parvathy AI for third-party claims arising from the content and materials you give us, or from your use of the services in breach of these Terms or the law. We will tell you about any such claim promptly and cooperate.

These Terms apply while you use our website or services. Either party may end a project as set out in its proposal or statement of work. You pay for work done up to the end date, and we hand over completed work and your materials once paid.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Disputes go to the courts in India having jurisdiction over Parvathy Technologies Pvt. Ltd.

We may update these Terms by posting a new version with a new effective date. Changes do not alter a project already under a signed scope unless both parties agree in writing.
